Ordinary naturalisation

Monaco citizenship does not follow automatically from residence. Article 5 of Law No. 1.155 sets an ordinary condition of ten years of habitual residence in the Principality after the age of eighteen. Meeting that condition allows a person to request naturalisation. Monaco's judicial administration states that the decision belongs entirely to the Sovereign Prince's discretion.

A residence card concerns permission to live in Monaco. Neither ownership of an apartment nor a bank balance replaces the nationality rules. Time spent growing up in Monaco cannot simply be added to adult residence to bring forward an application date. The law refers to habitual residence, rather than the length of property ownership or a banking relationship.

The applicant's record

A chronology of arrival dates, addresses and residence documents provides the factual basis for examining a possible application. Significant periods elsewhere also belong in that account. A qualified adviser can assess what the record establishes and which questions remain unresolved.

For a household considering relocation, the financial plan needs to stand without assuming that citizenship will follow. The suitability of a home and schooling can be assessed on that basis. Any separate need for a predictable nationality or immigration outcome requires its own assessment rather than reliance on a discretionary future decision.

Exceptional naturalisation

Article 6 permits the Prince to naturalise someone without the ordinary residence period where he considers that person worthy of the favour. This authority does not establish a published investment tariff or a predictable shortcut. The ordinary period likewise creates no entitlement to approval.

Professional fees for preparing a file are different from a promise to secure citizenship. An adviser can assemble documents and explain the procedure. That work cannot remove the discretion reserved to the sovereign decision. A relocation proposal needs to make clear what its quoted service actually covers.

Previous nationality

Judicial guidance identifies release from military obligations in the country of origin and renunciation of the previous nationality as additional requirements. Article 5 includes provisions concerning loss of the earlier nationality. These address, among other circumstances, a country that does not permit loss before another nationality has been acquired.

The legal sequence and its consequences require review in the relevant original jurisdiction before an irreversible step. Each family member's position may differ. A spouse's or child's nationality cannot be inferred from the principal applicant's arrangements. Familiarity with dual nationality elsewhere does not establish that all existing passports can be retained through Monaco naturalisation.

Birth and marriage

Birth in Monaco alone does not generally make a child Monegasque. Article 1 provides specific grounds involving parentage and adoption, together with a provision for children born in Monaco to unknown parents. The child's position depends on the applicable nationality laws, rather than the hospital's location alone.

Marriage has a separate declaration route. Law No. 1.512 introduced a twenty-year marriage period from 1 July 2022. A ten-year transitional period applies to foreign nationals who married a Monegasque before that date. Other conditions apply, so the marriage date and the spouse's nationality history require examination under the relevant provisions.

Application procedure

Official judicial guidance says a naturalisation request is addressed to the Prince at the Palace on stamped paper. The Direction des Services Judiciaires handles examination. Current practical requirements need confirming before submission. The instruction to an adviser should identify whether it concerns naturalisation, a family nationality route or permission to reside.

A written assessment can record the applicable provisions and supporting evidence, while identifying unresolved issues and matters of discretion.
